SMOOTH JAZZ 94.7 KSSJ 10K GIVEAWAY
OFFICIAL CONTEST RULES
The following rules (“Rules”) specifically apply to the KSSJ 10K Giveaway (“Contest”), conducted by Entercom Sacramento, LLC, d/b/a radio station KSSJ-FM/Sacramento (“Station” or “94.7 KSSJ”) between the period of April 21 – June 27, 2008 (“Contest Period”).
Who Can Enter:
1. To be eligible to participate in this Contest, entrants must be legal residents of the State of California, and 18 years of age or older. Employees of Station and its affiliated radio stations, KRXQ/KSEG/KCTC/KDND/KWOD, other radio stations in the Sacramento area and their respective affiliated companies, distributors, advertising and promotion agencies, and the immediate family members or household members (i.e., spouses, parents, grandparents, children, grandchildren, spouses, siblings, roommates and housemates) of each are ineligible to enter or win.
2. Station may require proof of age, identification and/or social security number prior to delivering a prize. Station reserves the right to examine identification and may choose to accept or deny awarding the prize based on the identification presented.
3. Contestants can participate as many times as they like and regardless of whether or not they have recently won any prizes in any other station contest.
How to Enter/How to Win:
4. No purchase is necessary to enter.
5. Every weekday (excluding dates of holidays or special events: May 26th/Memorial Day) from April 21, 2008 through June 27, 2008. Contestants must listen to 94.7 KSSJ-FM between 9am-4pm for a chance to participate in this contest. The KSSJ 10K Giveaway will be played 4 times each weekday. The approximate times for each running of the Contest are 9am, 10am, 11am and 12 noon. Just prior to each running, KSSJ will announce on air that it’s time to be the tenth (10th) caller to (916) 334-9479. The tenth (10th) caller will win $100 and qualify for the grand prize drawing of $10,000. Up to 196 qualifier winners will be selected in this manner.
6. Qualifiers who are also KSSJ Loyal Listener Club members on the date that they qualify for this contest will automatically receive one additional entry in the grand prize drawing. Station is able to determine the date and time when a listener has become a member of the Loyal Listener Club. The KSSJ Loyal Listener Club is an internet club that will entitle members to, among other things, receive information from 94.7 KSSJ and its clients, earn points to redeem for prizes, enter contests, participate in surveys and enjoy many other opportunities. There is no cost to become a member of the Loyal Listener Club. To become a member, simply visit www.kssj.com and follow the on-screen instructions. In order to register as a member and enter this contest, a person will be required to provide his or her full name, complete address, zip code, day and evening telephone numbers, e-mail address, and birth date. In the event of a dispute regarding the identity of an entrant, the holder of the e-mail account will be deemed the person who submitted the entry. The holder of the e-mail account is the natural person who is assigned the e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the second level domain associated with the e-mail address in question. Limit one membership per person and one membership per e-mail address. Entrants must provide all information requested on the Loyal Listener Club membership registration form and entry form for this contest. Incomplete forms will be disqualified, in Station’s sole discretion. Entrants are required to provide truthful information when completing the Loyal Listener Club membership registration form. If Station determines that any registration form contains false or fraudulent information or is submitted by a person other than the one named in the form or by an ineligible entrant, such form will be disqualified and the entrant who submitted the form will be prohibited from participating in this contest. All Loyal Listener Club membership registrations from ineligible entrants will be void.
7. The Station will randomly select one (1) grand prize winner on Friday, June 27th at 5 PM from among all qualifiers through that date/time. Grand prize winner need not listen to win. Station will only be required to leave one message at the number provided by the announced winner. If no answer or answering machine is reached, Station will not be obligated to attempt any further contact. However, Station reserves the right, in its sole discretion, to attempt to contact the winner more than once.
8. Only calls received to (916) 334-9479 are eligible (calls to the main radio station phone number or any other phone numbers are not acceptable). 94.7 KSSJ-FM is not responsible for loss of service to (916) 334-9479 or failure to make the call in time due to overload, busy signals, disconnected, misdirected, busy circuits, mechanical failures, or incomplete calls, or any other factor that may prevent an individual from completing his/her call to be the “right number caller”. In the event of interruption of power or telephone service to (916) 334-9479 during the contest, the radio announcer will have the sole right to determine whether or not to replay the contest at the resumption of service or cancel that “play”. If the Station receives less that the requested number of calls (e.g., only 9 callers when the Station is looking for the 10th caller to win), Station reserves the right to re-conduct that contest at a later time or cancel that winning opportunity and not award the associated prize. In the event that after an amount of time that Station (in its sole discretion) deems reasonable after the contest announcement there is no winner, Station reserves the right to re-conduct that contest at a later time or cancel that winning opportunity and not award the associated prize.
9. In the event that any $100 winner is disqualified for any reason, that qualifier shall not win any prize in this contest and that $100 will NOT be reawarded. In the event that any $10,000 winner is disqualified for any reason, that qualifier shall not win any prize in this contest and that $10,000 will be reawarded by Station by random drawing on a date selected by Station from among all then-eligible qualifiers (excluding any previous winners in this contest and any disqualified entrants).
The Prize & Odds of Winning:
PRIZES: EACH WEEKDAY UP TO FOUR WINNERS WILL RECEIVE $100 IN CASH. $100 CASH WINNERS QUALIFY FOR THE GRAND PRIZE OF $10,000. ONE (1) PERSON WILL WIN THE GRAND PRIZE. A TOTAL OF $29,600.00 IN CASH PRIZES WILL BE AVAILABLE TO BE WON IN THIS CONTEST.
10. Odds of qualifying depend on the number of people entering each running of the Contest. Odds of winning depend on number of qualifiers and the number of qualifiers who are KSSJ Loyal Listeners, but will range between one out of 196 to one out of 392.
11. A maximum of 196 listeners will win $100 and qualify for the $10,000 cash prize. If the qualifier is a KSSJ Loyal Listener, they will get one additional entry into the grand prize drawing for a maximum of 392 entries into the grand prize give away.
12. Prizes will be released to winners only. Winners are required to present a valid state photo ID and valid social security number in order to pick up any prize. All cash prizes shall be paid by Station in the form of a company check. Prize checks will be available for pick-up at the Station studios within 30 days of winning. Prizes will not be mailed. Prior to being entitled to receive any prize in this contest, winners are required to sign a Release and Eligibility Affidavit which, among other things, relieves and releases the Station, and their sponsors from any and all liability with respect to any injuries, losses or damages of any kind caused by or resulting from (a) participation in the contest and/or (b) the acceptance, possession and/or use of any prize awarded hereunder. Any person who refuses to sign the Release will forfeit the contest prize and the prize will NOT be re-awarded. Notwithstanding the absence of such executed Release, all contestants acknowledge and agree that by participating in the Contest that Station, and their parent, subsidiaries, officers, directors, employees, agents, contest sponsors and affiliated companies, and advertising and promotion agencies accept no responsibility of liability in connection with this contest or the prize.
13. The Station may report the total dollar amount of the prize awarded to the Internal Revenue Service and may furnish the winner with an IRS Form 1099, if applicable. Each winner is solely responsible for payment of any and all taxes incurred as a result of the award of this, or any other, prize.
14. Failure to collect the prize and execute all required forms within 90 days of receiving notification that the prize is ready for pick-up constitute automatic forfeiture of the prize. If forfeited, the prize will remain the property of the Station.
15. Prizes are non-transferable.
Other Rules:
16. KSSJ Loyal Listener club membership registrations or entries that are determined by Station management to be fraudulent, incomplete, illegible or duplicates will be void and the person making such an entry barred from further participation.
17. All entries and registrations become the property of the Station and will not be acknowledged or returned. By registering for KSSJ Loyal Listener club, all participants agree to Station’s use of all personal information as described in the privacy policy of Entercom Sacramento LLC and KSSJ-FM available at www.kssj.com.
18. Station is not responsible for loss of service to the Studio/Contest Phone Number due to overload, busy signals, or any other factors that may prevent an individual from completing his/her call.
19. Station cannot be held liable for (a) any lost or stolen membership entries or registrations, prizes or contest information, (b) any attempted registration or award claim that are misdirected, lost, disconnected, not fully received, illegible or inaudible, nor (c) any technical malfunction related to any computer network, software, internet access, ISP's, servers, routers, or any other technical problem that may impact registration or prize claim including, without limitation, any internet telephone call connections, fax transmission or telephone calls.
20. By participating in this contest, each entrant hereby consents to Station and its sponsors using the contestant’s name, voice, likeness, biographical information, hometown, his/her participation in the contest, and the substance of the contestant’s entry (in whole or in part) for on-air broadcast and for advertising and promotional purposes. Entrant agrees that no additional compensation will be paid for such usage.
21. Station reserves the right to make new rules, amend existing rules, contest changes and change the aforementioned contest dates without prior notice. Station shall be the sole arbiter in all matters relating to the contest and the interpretation of the contest rules. The decisions of Station shall be final.
22. Station reserves the right to suspend, cancel or stop this contest at any time and for any reason.
23. Entry into Station contests and membership in KSSJ Loyal Listener club constitutes agreement to abide by these rules.
24. If any provision of these rules should ever be held to be invalid or unenforceable, such invalid or unenforceable provision(s) shall be revised by Station and shall not affect any other provisions of these rules, and such other provisions shall continue in full force and effect.
25. 26. A list of winners will be available after June 30, 2008 by sending a self-addressed stamped envelope to 5345 Madison Avenue, Sacramento, CA 95841 or by sending attention: KSSJ 10K Give Away List.
27. This contest is subject to all applicable laws and regulations and is void where prohibited. |
